ICE ECX CFI CER FUTURES CONTRACTS EXPLANATORY MEMORANDUM
1. The Exchange uses the following definitions of “Certified Emission Reduction” (CER) and “CER type” in the ICE Futures Europe Regulations. This will exclude CERs generated by the following:
- nuclear facilities;
- land use, land use change and forestry activities (LULUCF); and
- hydroelectric projects with a generating capacity exceeding 20 MW.

means any type of CER other than those determined and notified to Members by the Exchange from time to time. For any CER Type, the Exchange may specify such criteria as it deems appropriate, including without limitation the project type, nature and source of a CER, the scheme and/or mechanism pursuant to which such CER has been issued and the originating or issuing registry; |
| “Certified Emission Reduction” (“CER ”) |
means a unit issued by the UN Clean Development Mechanism Executive Board pursuant to Article 12 of the Kyoto Protocol and the decisions adopted pursuant to the UNFCCC or the Kyoto Protocol and is equal to one metric tonne of carbon dioxide equivalent. |
2. The Exchange places an obligation on the Seller’s Clearing Member to ensure that the CERs delivered to the Person Holding Account of the Clearing House meet this definition of ‘CER Type’. In addition, the Buyer is required to inform the Clearing House if it identifies a CER as not meeting this definition of ‘CER Type’. In the event that CERs are delivered which do not meet the definition of ‘CER Type’ this will be a failure in performance of obligations and subject to the Performance Failure and Delivery Costs Rules (II.12)

3. A quarterly expiry cycle of 16 contract months from March 2009 to December 2012 on a March, June, September and December cycle.
